These terms and conditions apply to all users of the E-business Guide (the Site).
1. Copyright: The contents of the Site are the copyright of New Zealand Trade and Enterprise or suppliers to it. No part of the Site may be distributed or copied for any commercial purpose and you are not permitted to incorporate the material or any part of it in any other work or publication (whether in hard copy, electronic or any other form) without the prior written consent of NZTE.
2. Linking: The contents of the Site may include links to third party materials (Linked Sites). NZTE is not responsible for the contents of any Linked Site and the inclusion of any link does not imply NZTE’s endorsement of the Linked Sites. NZTE reserves the right to prohibit links to the Site and you must remove or cease any link at NZTE’s request. 3. Advertisers: Any dealings with any advertiser appearing on the Site are solely between you and the advertiser. NZTE is not responsible or liable for any part of any such dealings or promotions.
4. Registration: NZTE reserves the right to reject any application for registration.
Privacy
5. Collection: NZTE may gather two types of information about you from the Site:
(a) personal information, provided by you at the time of voluntary registration for the services offered; and
(b) aggregate information generated by NZTE’s systems, which track traffic to the Site but do not relate to you personally.
6. Disclosure of Information: NZTE may disclose:
(a) any information that NZTE gathers about you to third parties for the purposes of providing you with additional services;
(b) aggregate tracking information and other information that does not personally identify you, to third parties;
(c) your personal information to third parties, when NZTE believes in good faith that NZTE is required to do so by law;
(d) your personal information to third parties, provided NZTE has your prior authorisation, which NZTE will usually obtain at the time of collecting the information from you.
7. Use: NZTE uses the personal information it collects:
(a) to verify your identity and assist you if you forget your password or login details for any of NZTE’s registration services on this Site;
(b) to assist in providing the services requested by you;
(c) to provide further information to you about other websites and services or which NZTE considers may be of interest to you;
(d) for future marketing, promotional and publicity purposes, including to carry out direct marketing, market research and surveys;
(e) for ensuring that you are shown the information that is most relevant to you and your interests; and
(f) for any other use that you authorise.
8. Cookies and Tracking: NZTE uses a 'cookie' file containing information that can identify details of your IP address, PC platform (for example, Windows, NT or Mac), Browser (for example, Internet Explorer, Netscape or other, plus the version of Browser), domain (whether you are accessing the Site from New Zealand or elsewhere) and other user information (for example, your username).
NZTE may use the information generated by cookies to:
(a) track traffic patterns to and from the Site;
(b) ensure any advertising is being shown to the most appropriate person; and
(c) enable you to enter the Site and use certain services and to visit registered user only areas of the Site. You can choose to refuse cookies by turning them off in your browser and/or deleting them from your hard drive. You do not need to have cookies turned on to use the Site but you will need them to log on to the Site and to access personalised or secure content on the Site. Some pages may not function properly if the cookies are turned off.
9. Content Providers, Advertisers and Partners: NZTE does not control the practices of content providers, partners and advertisers connected with the Site and to whom you provide personal information whilst using one of the Site or services.
10. Holding, Correcting and Updating: Any personal information that you provide to NZTE will be collected and held by NZTE at its offices at 23 Albert Street, Auckland, New Zealand. 11. Disclaimer: The Site makes certain information and material available to you as a service, either through NZTE, its suppliers or otherwise. NZTE does not offer any opinion with respect to the nature, potential value or suitability of any particular transaction or strategy. Use of information contained on the Site is at your own risk and NZTE is not responsible for any adverse consequences arising out of such use. NZTE recommends that you discuss with your professional advisers the applicability of the information on the Site to your specific situation.
The availability of information on the Site does not constitute a recommendation by NZTE or any other person into any transaction. Nor is NZTE to be treated as an issuer or promoter or as offering securities to any person. If you enter into any transaction subsequent to accessing the Site, you do so entirely in reliance on your own judgement and inquiries and not in reliance on any statements, warranties or representations (other than the warranties set out in such agreement) made to you or to any other person by or on behalf of NZTE. You release NZTE from all claims arising from any statement or representation made on the Site.
12. Limitation of Liability and Indemnity: NZTE does not give any warranty of accuracy, reliability or fitness for any purpose of the information contained on the Site to you or any other person. To the fullest extent permitted by law, NZTE excludes all responsibility and liability in relation to the Site and NZTE will not be responsible for errors or misstatements or be liable, whether in contract, tort (including negligence) or otherwise, for any loss or damage however caused (including direct, indirect, consequential, special, or loss of profits).
13. Amendments: NZTE reserves the right to change the information on the Site at any time. NZTE reserves the right to change these terms and conditions of use, the Registered Users’ Specific Terms and Conditions and the Privacy Statement (Amendments) at any time by notifying users of the existence of the Amendments through the Site. By continuing to access the Site, you agree to be bound by the Amendments.
14. Law: These terms and conditions and the Privacy Statement are governed by and will be construed in accordance with the laws of New Zealand and you submit to the jurisdiction of the courts of New Zealand.
